Excerpt from Völkerrecht und Landesrecht Wenn wir nun von einem Verhältnisse zwischen Völker und Landesrecht sprechen, so setzen wir etwas als gegeben vor aus, wae keineswegs ausser Streit steht, und was, wenn es nicht angefochten wird, doch leider nur zu oft unbeachtet bleibt: dass es ein Völkerrecht giebt, und dass dieses Recht etwas ande res ist als Landesrecht. Gäbe es kein Völkerrecht, oder wäre das, was man etwa so nennt kein Gegensatz zum Landesrecht, so hätte unsere Frage keinen Sinn. Gewiss auch wenn man die Existenz eines vom Landesrechts verschiedenen Völker r e c h ts leugnet, wird man doch eine irgendwie beschafleno, meinethalben auf Moral oder Sitte beruhende Ordnung der äusseren Bezie hungen von Staat zu Staat niemals in Abrede stellen, und ganz müssig dürfte auch eine Untersuchung des Verhältnisses dieser Ordnung zum staatlichen Rechte nicht sein. Sie hätte indess gegenüber der allgemeinen Aufgabe, im Rechte den Niederschlag anderer, nicht rechtlicher Normen nachzuweisen die "fontes remotae des Rechts aufzndecken, keinen selbständigen Werth. Ebenso würde es zwar für den Fall, dass sich das Völkerrecht zum Landesrechts etwa nur verhalten sollte wie der Theil zum Ganzen, nicht ganz überflüssig sein, dem Verhältnisse dieses Theile zu anderen Theilen nachzugehen, z. B. Wie man die Beziehungen zwischen Privat und Strafrecht untersucht. Aber immerhin hätte dies eine untergeordnete Bedeutung im Vergleiche mit der Auf gabe, die Beziehungen zweier gesonderter Rechtskomplexe klarzustellen.
