English summary: Michael Heese has developed the first system of creditors' information in insolvency on the basis of German constitutional law and a comparative analysis of American insolvency law in the form of the Bankruptcy Code. From a creditor's perspective, information in a case of bankruptcy is the basis for enforcing claims, for participation in the proceedings, and for the transparency of the proceedings. Michael Heese provides a comprehensive analysis of the shortcomings of the current restrictive prevailing opinion in Germany regarding information as expressed in legislation, judicial opinions, and scholarly commentary. His analysis is based primarily on the goals of the information system, the constitutional guarantees which must be considered when implementing these goals, and a comparison with American law. The author's observations regarding the weaknesses in current German law result in his suggestions for legislative reforms to the extent that the weaknesses cannot be addressed in a manner that conforms to the existing system. Dabei werden die Justizgewahrleistung, der Anspruch auf rechtliches Gehor und effektiven Rechtsschutz sowie die Gleichbehandlung im Verfahrensrecht in ihrer durch die Institutsgarantie des Insolvenzverfahrens erlangten besonderen Auspragung ebenso eingehend behandelt wie die den Informationsfluss begrenzenden Vorgaben des schuldnerischen Kreditschutzes, des Unternehmensgeheimnisschutzes und des allgemeinen Personlichkeitsrechts. Der Autor entwickelt die Informationsordnung des deutschen Insolvenzrechts fur ihre Hauptverfahrensabschnitte: das Eroffnungsverfahren, das eroffnete Verfahren und die Abweisung des Eroffnungsantrags mangels Masse. Jedem Abschnitt stellt er eine umfassende rechtsvergleichende Analyse des U.S.-amerikanischen Insolvenzrechts voraus. Die durch Verfassungsinterpretation und Rechtsvergleich hervortretenden Schwachen des geltenden deutschen Rechts werden soweit moglich systemkonform korrigiert und im Ubrigen zur Reform durch den Gesetzgeber empfohlen.Das Buch wurde mit dem Wissenschaftspreis 2008 des Gravenbrucher Kreises und mit dem Fakultatspreis 2009 der Juristischen Fakultat der Georg-August-Universitat Gottingen ausgezeichnet.

All modern legal systems with advanced economies must address the question of how to respond to the needs of insolvent consumers whose burden of debt greatly exceeds their capacity to repay within a reasonable time frame. This study surveys comparatively the insolvency regimes currently in place or likely to be adopted in the foreseeable future in Canada,the United States, Australia, England and Wales, Scotland, Scandinavia and a representative group of Western countries on the continent of Europe. Modern legal systems have two basic alternatives in providing relief for over-committed consumers. The first, which involves restricting the enforcement of individual creditor remedies is a method with which this study is not concerned. Where the consumer is seriously insolvent and owes money to many creditors, a different approach is required -- a collective solution to debtor's problems ? and this, the solution provided by modern insolvency systems, is the focus of this study.

Nach aktuellen Schätzungen sind gegenwärtig ca. 6,85 Mio. Menschen in Deutschland nicht mehr in der Lage, nach Abzug ihrer Lebenshaltungskosten fällige Verbindlichkeiten zu begleichen. Damit befindet sich die Anzahl überschuldeter Privatpersonen auf einem historisch einmalig hohen Niveau. Ausgehend von diesen Ergebnissen, beschäftigt sich die Arbeit mit den seit 1999 geltenden Regelungen zu Verbraucherinsolvenz und Restschuldbefreiung. Diese wurden eingeführt, um überschuldeten Privatpersonen die Möglichkeit eines schuldenfreien Neustarts zu eröffnen. Die Arbeit überprüft, inwiefern die vom Gesetzgeber verfolgten Ziele bis dato erreicht wurden und worin mögliche Gründe für die allenfalls partielle Wirksamkeit des Vorhabens liegen. Es handelt sich insofern um einen Beitrag zur Wirkungsforschung von Gesetzen. Im Rahmen dieser Forschungsfrage beschäftigt sich die Arbeit ausführlich mit dem Phänomen privater Überschuldung und seinen gesellschaftlichen Hintergründen und Ursachen.

Consumer Credit and the American Economy examines the economics, behavioral science, sociology, history, institutions, law, and regulation of consumer credit in the United States. After discussing the origins and various kinds of consumer credit available in today's marketplace, this book reviews at some length the long run growth of consumer credit to explore the widely held belief that somehow consumer credit has risen "too fast for too long." It then turns to demand and supply with chapters discussing neoclassical theories of demand, new behavioral economics, and evidence on production costs and why consumer credit might seem expensive compared to some other kinds of credit like government finance. This discussion includes review of the economics of risk management and funding sources, as well discussion of the economic theory of why some people might be limited in their credit search, the phenomenon of credit rationing. This examination includes review of issues of risk management through mathematical methods of borrower screening known as credit scoring and financial market sources of funding for offerings of consumer credit. The book then discusses technological change in credit granting. It examines how modern automated information systems called credit reporting agencies, or more popularly "credit bureaus," reduce the costs of information acquisition and permit greater credit availability at less cost. This discussion is followed by examination of the logical offspring of technology, the ubiquitous credit card that permits consumers access to both payments and credit services worldwide virtually instantly. After a chapter on institutions that have arisen to supply credit to individuals for whom mainstream credit is often unavailable, including "payday loans" and other small dollar sources of loans, discussion turns to legal structure and the regulation of consumer credit. There are separate chapters on the theories behind the two main thrusts of federal regulation to this point, fairness for all and financial disclosure. Following these chapters, there is another on state regulation that has long focused on marketplace access and pricing. Before a final concluding chapter, another chapter focuses on two noncredit marketplace products that are closely related to credit. The first of them, debt protection including credit insurance and other forms of credit protection, is economically a complement. The second product, consumer leasing, is a substitute for credit use in many situations, especially involving acquisition of automobiles. This chapter is followed by a full review of consumer bankruptcy, what happens in the worst of cases when consumers find themselves unable to repay their loans. Because of the importance of consumer credit in consumers' financial affairs, the intended audience includes anyone interested in these issues, not only specialists who spend much of their time focused on them. For this reason, the authors have carefully avoided academic jargon and the mathematics that is the modern language of economics. It also examines the psychological, sociological, historical, and especially legal traditions that go into fully understanding what has led to the demand for consumer credit and to what the markets and institutions that provide these products have become today.

This book presents a radically different argument for what has caused, and likely will continue to cause, the collapse of emerging market economies. Pettis combines the insights of economic history, economic theory, and finance theory into a comprehensive model for understanding sovereign liability management and the causes of financial crises. He examines recent financial crises in emerging market countries along with the history of international lending since the 1820s to argue that the process of international lending is driven primarily by external events and not by local politics and/or economic policies.
